CONTRACT OF EMPLOYMENT


1. Domestic [or household service] “HELPER”, “HOUSEHOLD HELPERS” OR “KASAMBAHAY” [shall mean service in the employer’s home which is usually necessary or desirable for the maintenance and enjoyment thereof  and includes ministering to the personal comfort and convenience of the members of the employers households, including services of family drivers.] Refers to any person, who renders for compensation, to a Homeowner/Employer undertaking tasks ascribed as normal household chores within a specific households. The term includes maids, cooks, houseboys and “yayas” who provide daily service, either on a full-time, live-in or live-out basis.


2. Contract of Domestic Service. [The original contract of the domestic service shall not last for more than two (2) years but it may be renewed for such periods as may be agreed upon by the parties.] All household working arrangements or agreements shall be covered by a written employment contract. In a language or dialect understood by both the employer and the contracting party shall be provided with a complete set of the duly signed contract of service which shall include the following:


3. PERIOD OF EMPLOYMENT

The Employer and the Employee shall agree in terms of the employment period and that the Employer shall review the employment contract of their house helpers every three (3) with the end view of improving the terms and condition thereof.

3.1.1 TERMINATION OF CONTRACT

a. Misconduct or willful disobedience by the kasambahay of the lawful order of

the employer in connection with the former’s work;

b. Gross or habitual neglect or inefficiency by the kasambahay in the

performance of duties;

c. Fraud or willful breach of the trust reposed by the employer on the

kasambahay;

d. Commission of a crime or offense by the kasambahay against the person of

the employer or any immediate member of the employer’s family;

e. Violation by the kasambahay of the terms and conditions of the employment

contract and other standards set forth under the law;

f. Any disease prejudicial to the health of the kasambahay, the employer, or

member/s of the household; and

g. Other causes analogous to the foregoing.


 

4. COMPENSATION AND MODE OF PAYMENT

The Employee shall receive Three Thousand Eight Hundred Pesos (P3800.00) a month as compensation in cash. The monthly compensation for the Employee shall be given every 7th and 22nd of the month.

The Employee will also receive Three Hundred Pesos (P300.00) every Monday for her Food Allowance, for a total of One Thousand Two Hundred Pesos (P1200.00) a month, thus will be deducted from her monthly salary.






4.1 THIRTEENTH MONTH PAY

The Employee who has rendered at least one (1) month of service is entitled to a thirteenth-month pay which shall not be less than one-twelfth (1/12) of the total basic salary earned in a calendar year.


4.2 BENEFITS

The Employer shall provide the Employee the privilege to have the membership for the following benefits: Social Security System (SSS), Pag-IBIG and PhilHealth. The Employer has the obligation to register in behalf of the Employee. After rendering for one (1) month of service, the mentioned benefits will be deducted from the monthly salary given on the 7th and 22nd of the month.


4.3 SERVICE INCENTIVE LEAVE

An Employee who has rendered of at least one (1) year of service shall be entitled to an annual service incentive leave of at least five (5) days with pay.

Any unused portion  of said annual leave shall not be cumularive or carried over to the succeeding years. Unused leaves shall not be convertible to cash.


4.4 LOAN ARRANGEMENT (CASH ADVANCE)

The Employee has the privilege to ask for loan or cash advance to her Employer, however the Employee could only ask for loan/cash advance once every two (2) months provided she was able to work for at least ten (10) days after the last salary.

 


5. DUTIES AND RESPONSIBILITIES

The Employee shall fulfill the following duties:

- cleaning the the entire house including the rooms

- doing the laundry

- cooking meals


6. WORKING HOURS AND DAY-OFF SCHEDULE

The Employee shall have a 24-hour rest time, specifically from Saturday at 6:00PM to Sunday 6:00PM every week.


7. LIVING QUARTERS OR SLEEPING ARRANGEMENT

The employer shall furnish the house helper free of charge suitable and sanitary living quarters as well as medical assistance.


8. REQUIREMENTS

The Employee shall present Barangay Clearance, Medical Certificate and one valid ID as prerequisites for employment in domestic work. The Employer shall provide for the expenses of the requirements.
